Container Home Permitting by Country: Complete Guide

The #1 question we get: “Do I need a permit for a container home?” The answer depends on size, location, and use. Here’s the global picture.
United States
Container homes in the US are classified as “prefabricated buildings” and must meet the same International Residential Code (IRC) standards as any dwelling. However, the permitting burden scales with size:
- Under 120 sqft (11 sqm): No permit in most jurisdictions. Classified as a storage shed. 10FT models do NOT fall under this — they’re livable dwellings.
- 10FT Expandable (18.5 sqm): Building permit required in nearly all urban and suburban areas. Often qualifies as an ADU (Accessory Dwelling Unit) in single-family zones. Permit cost: $500-$2,000.
- 20FT-40FT (37-74 sqm): Full building permit required. Must meet all IRC requirements including foundation, electrical, plumbing, insulation, egress, and structural engineering. Plan review: 2-6 weeks.
- On wheels (no foundation): Classified as an RV in most states. No building permit needed, but must meet RVIA standards. Cannot be occupied full-time in most jurisdictions (30-180 day limits).
Canada
Canada follows the National Building Code (NBC) which recognizes prefabricated structures. Requirements vary by province:
- Ontario: Ontario Building Code (OBC) Part 9 applies. Permit required for any structure over 10 sqm used as a dwelling. Our 10FT (18.5 sqm) requires full permit.
- British Columbia: Step Code compliance needed for energy efficiency. Our upgraded insulation package (R-21 walls, R-28 roof) meets Step 3 requirements.
- Alberta: No provincial energy code (yet). Building permit required for any habitable dwelling regardless of size.
- Rural/unorganized areas: Many northern and remote areas have simplified permitting or exempt owner-built dwellings from full code compliance.
United Kingdom
Permitted development rights (no planning permission) apply to structures under 2.5m height at boundaries, 15 sqm floor area, and not used as sleeping accommodation. Container homes used as dwellings ALWAYS require planning permission. Key requirements:
- Building Regulations approval (Part A-L compliance)
- Planning permission for change of use (if not already residential)
- Structural engineering calculations for UK wind and snow loads
- Thermal performance minimum: U-value of 0.18 W/m²K for walls

Australia
Each state has its own rules, but the National Construction Code (NCC) applies nationally for structural matters:
- Queensland, NSW, Victoria: Full building approval required for any container home. Must comply with NCC Volume 2 (housing provisions). Bushfire Attack Level (BAL) ratings matter in fire-prone areas — steel is BAL-FZ (Flame Zone) rated without modification.
- Rural Western Australia, South Australia: Some shires exempt container homes under 50 sqm from full approval if used as temporary accommodation. Check your local shire’s local planning scheme.
- Cyclone regions (QLD north of Mackay, NT, WA Kimberley): Containers must be engineered for cyclonic wind loads (Region C/D). Our standard anchoring system is rated to 180 mph winds — sufficient with upgraded ground anchors.
General Rule
If you plan to sleep in it, you need a permit. If it’s purely storage or workshop and you’re not running a business from it, most jurisdictions exempt structures under 10-15 sqm.
